We continue to experience significant growth and are very motivated to add an ERISA Tax Partner to advise on technical issues that arise as part of client matters and eventually grow out an entire department dedicated to the niche.
Responsibilities:
- Advise clients on compliance with ERISA, the Internal Revenue Code, COBRA, ACA, HIPAA, and other benefits-related laws and regulations. Matter types will include audits, mergers and acquisitions, fund formation, business planning, and tax structuring.
- Draft, review, and amend qualified retirement plans, nonqualified deferred compensation plans, health and welfare plans, and executive compensation arrangements.
- Assist with due diligence and benefits-related issues in M&A and other corporate transactions.
- Handle IRS and DOL correction programs and audits.
- Collaborate with clients, in-house counsel, HR professionals, and third-party vendors.
Qualifications:
- JD from an ABA-accredited law school and admitted to practice in any one or more of New York, California, Florida, New Jersey, or Connecticut (but New York is preferred). Master of Laws in Taxation strongly preferred, especially with an employee benefits concentration.
- Five or more years of ERISA and employee benefits experience at a law firm or similar professional services setting.
- Strong knowledge of tax-qualification rules, benefits compliance, and fiduciary responsibilities under ERISA; history of addressing audits by both IRS and DOL.
- Demonstrated history of handling matters of at least medium difficulty and complexity as primary attorney.
- Comfort with training younger staff, collaborating across different departments within the firm, and eventually handling the administrative responsibilities of running a practice group.
Preferred:
- Experience working with a broad client base, including startups, public companies, and nonprofit organizations.
- Master of Laws in Taxation from one of NYU, Georgetown, Boston University, or Florida.
- Familiarity with executive compensation and equity incentive plans is a plus, especially the corporate drafting associated with those plans.
Salary range: $180,000-$315,000
